Terms of Service

Governing your rights and purchases on Independence Store Australia.

INDEPENDENCE STORE

Website Sales Terms and Conditions

Effective: 9 September 2026

These terms govern use of our website and purchases from Independence Store Pty Ltd. They should be read with our Privacy, Shipping, Returns and Warranty Policies.

1. About us

The website is operated by Independence Store Australia Pty Ltd (ACN 701 595 235), of 27/211 Brisbane Road, Biggera Waters QLD 4216. “We”, “us” and “our” mean Independence Store.

2. Website use

You must use the website lawfully and must not interfere with security, operation, content or other users. Product information is general information and is not medical, clinical, financial, NDIS or aged-care advice.

3. Product suitability and information

Check specifications, dimensions, capacities, compatibility and intended use before ordering. Seek qualified clinical advice where appropriate. Images may be illustrative and colours may vary. We take reasonable care with descriptions but may correct genuine errors.

4. Orders and contract formation

Your order is an offer to buy. An automated acknowledgement is not acceptance. We accept an order when we confirm acceptance or dispatch the goods. We may refuse or cancel before acceptance because of availability, pricing error, suspected fraud, delivery limitations or legal restrictions, and will refund amounts paid for cancelled items.

5. Pricing, GST and payment

Prices are in Australian dollars and include GST where applicable unless stated otherwise. Delivery and optional services may be additional. Payment must clear before dispatch unless approved invoice terms apply. We may perform reasonable fraud and identity checks.

6. Availability and supplier-direct fulfilment

Many products are fulfilled by third-party suppliers. Stock indicators and dispatch dates may change. If an item becomes unavailable, we will offer an appropriate alternative, revised timeframe or refund for the unavailable item.

7. Delivery

Delivery is governed by our Shipping Policy. Provide correct details and safe access. We will not exclude responsibility that the ACL places on us for supply and delivery.

8. Returns, faults and warranties

Change-of-mind returns are governed by our Returns Policy and may not be available. Approved returns may incur return freight and a restocking fee of up to 35%. These conditions do not apply to the extent they conflict with non-excludable rights for faulty or non-compliant goods. Our Warranty Policy explains claims and remedies.

9. Funding and third-party payment

A quote or invoice does not guarantee NDIS, Support at Home, plan-manager or provider approval. You are responsible for confirming eligibility, budget, approvals and any personal contribution. We may wait for written approval or cleared payment before supply. If a third party does not pay, the purchaser remains responsible unless we expressly agree otherwise.

10. Cancellations

Contact us promptly. Cancellation is not guaranteed once an item is ordered from a supplier, customised or dispatched. We will not impose cancellation terms that unlawfully restrict consumer rights.

11. Liability

Nothing excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded. To the maximum extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable, and our liability may be limited to a remedy permitted by law.

12. Intellectual property and links

Website content is owned by us or licensed to us. You may use it for personal shopping purposes, but not reproduce or commercially exploit it without permission. Third-party links are provided for convenience; their content and practices are controlled by those third parties.

13. Privacy and security

Our Privacy Policy explains personal-information handling. Do not email passwords or complete card details. You are responsible for keeping account credentials secure and notifying us of suspected unauthorised use.

14. Changes, severability and waiver

We may update these terms prospectively by posting a revised effective date. Terms applying to an accepted order will not be changed retrospectively without agreement. If a term is unenforceable, the remaining terms continue. A delay in enforcing a right is not a waiver.

15. Governing law and disputes

These terms are governed by Queensland law and applicable Commonwealth law. First contact us so we can try to resolve the concern. You may also contact the relevant state consumer agency or seek independent advice.
